NC hits out at Pak for 'interfering' in J&K on Article 35A

Following her meeting with Prime Minister Narendra Modi, Jammu & Kashmir Chief Minister Mehbooba Mufti said she received "100 percent assurance" on maintenance of the status quo of Articles 370 and 35A of the Constitution, which provide the state its "special status". Senior BJP Leader Virendra Gupta, while speaking to PTI, said the time has come for Articles 35A and 370 to be struck down, as they promote a "separatist psyche" in the Valley.

Mehbooba Mufti told reporters in New Delhi on Friday that the Central government should accommodate the idea of Jammu and Kashmir within the Union with all the special provisions that Article 370 guarantees.

It is against this backdrop, it is pertinent to understand the provisions of the Article 35A and the arguments in favour and against the Article, which are provided below.

The NC said the BJP is using the people of Hindu-majority Jammu region of the state as a pawn in its national politics.

When Article 35A was introduced in 1954 it superseded J&K state subject law enacted by Maharaja in 1927.

Shops and other businesses and educational institutions remained closed and public transport stayed off the roads in Kashmir Valley and parts of Kishtwar and Doda districts of Jammu. For mainstream political parties, who are confronting their biggest ever crisis these days, leaders are unsure if they can continue as mainstream (pro-India ) politicians if the Supreme Court strikes down the law.

The OIC said this in response to a recent press release by the Indian Ministry of External Affairs regarding the resolution adopted on Jammu and Kashmir.

"If 35 (A) is repealed then the Article 370 will also be weakened", said Rana. But after the party forged an alliance with the PDP in Jammu and Kashmir, they promised to maintain the special status in the Agenda of Alliance which defines their partnership in running the government.

Professor Hari Om, a historian and social activist, said, "It is an atrocious article that creates a high wall between people of J&K and the rest of India".

The article has been challenged in the Supreme Court through a petition being heard by a three-judge constitutional bench.

Meanwhile, reports said that during her meeting with PM Modi she complained about the "arrogant attitude" Power Minister Piyush Goal regarding the transfer of two hydro-electric projects back to J&K.
