Minnesota's Bureau of Criminal Apprehension has handed over its preliminary investigation to the Hennepin county lawyer, who will now decide next steps.

A decision is expected by the end of the year.

Ruszczyk, known professionally as Justine Damond, had called police late on a Saturday night to report that she thought she'd heard a female yell help outside her home in the city's Fulton neighborhood, telling the 911 operator she was anxious a woman was being attacked.

The 40-year-old yoga instructor and life coach from Sydney's northern beaches was shot dead in her pyjamas by Officer Noor behind her Minneapolis home on the night of July 15.

However, a charge of second-degree manslaughter is more likely, he said.

At the time of the death, Officer Noor's partner, Officer Harrity, told Minnesota's Bureau of Criminal Apprehension that Noor shot Damond through their squad auto door as she walked down her driveway to greet them.

Officer Noor has refused to answer investigators' questions over what caused him to unleash his firearm.

Meanwhile, the investigation will remain open while it's reviewed by the county attorney's office. "[But] it's way too premature for us to make that call yet". Damond, an Australian native who was engaged to be married last month, was shot as she approached the squad vehicle.

Don Damond released a statement Tuesday, shortly after state investigators announced they have finished investigating the death of Justine Damond and have forwarded the case to prosecutors for possible charges.

Justine's fiancé Don Damond has urged County Attorney Mike Freeman to lay charges, saying "the wait continues for Justine's family and me".
