The OVP and the FPO voted against same-sex marriage in parliament a few months ago.

Austria's highest court ruled Tuesday to fully legalize marriage equality by 2019 after declaring the law restricting LGBTQ partnership to civil unions discriminatory.

"The resulting discriminatory effect is seen in the fact that. people living in same-sex partnerships have to disclose their sexual orientation even in situations, in which it is not and must not be relevant, and. are highly likely to be discriminated against", the court said in its ruling.

The Court made a decision to take out the phrase "different sex", which now gives same-sex couples the option to marry instead of get a civil partnership like before.

As it now stands, same-sex couples in Austria had been allowed to enter civil partnerships for the last seven years.

Helmut Graupner, a lawyer for the two women who brought the case, wrote in a Facebook post that "today is a truly historic day".

The Constitutional Court sided with two women who complained they were refused permission to marry by authorities in the capital Vienna. The repeal will allow same-sex couples to get married and allow mixed-sex couples to enter registered partnerships.

With the ruling, Austria becomes the 16th European country to grant marriage equality.

According to The New York Times, the court advised that gay couples be allowed to marry starting in 2019, unless lawmakers act sooner.
