Intelligence agency to submit fresh request after filing charge sheet.

Naik said, "I am relieved by Interpol cancelling RCN, but I would have been more relieved had the Indian government cleared me of all the false charges".

After hearing the plea and also the Indian government arguments, the Commission for the Control of Interpol's Files observed on 26 October, 2017, "The commission considered that according to the Ministry of External Affairs, an extradition request for an accused /fugitive can be initiated after a charge sheet has been filed". The commission concluded that data on Naik should be deleted from Interpol files as the objective of the red notice "cannot be achieved at this stage". India is planning to request the Malaysian government for his extradition. "Will now submit fresh request to Interpol as chargesheet has already been filed in the concerned NIA court in Mumbai", ANI reported quoting a source in the intelligence agency.

"After thorough examination of the elements before it, the commission found that the data challenged raised questions as to compliance with applicable rules". Following the charges, the National Investigation Agency (NIA) in November a year ago registered a criminal case against him.

The National Investigation Agency had in November filed a chargesheet against Naik, accusing him of promoting enmity between religious groups through his speeches and inciting youths to take up terror activities.

Naik fled India after he was accused of influencing terrorists involved in terror strike in Dhaka on July 1, 2016.

The decision was sent to the Interpol General secretariat which deleted the data from the Interpol's files in November 2017. His Islamic Research Foundation (IRF) has also been proscribed.

Reacting to this, the NIA said that the INTERPOL canceled the request as charge sheet was not filed at the time of lodging the request with the worldwide agency.

Last year, the National Investigation Agency's Mumbai branch had registered a case against Naik under various sections of the Indian Penal Code and Unlawful Activities (Prevention) Act (UAPA) after the Union Home Ministry had declared his Mumbai based IRF as an unlawful association.
